Deployed Service Members in the Military
There are oftentimes jurisdictional issues when a service member in the military is seeking a divorce. Service members are many times deployed during the divorce process, whether out of state or overseas. However, just because a service member is serving on a Colorado military base does not mean Colorado has jurisdiction. Our skilled and knowledgeable attorneys can review your particular case and explain how your jurisdictional issue can be resolved.
In addition, there are child custody and property division issues to consider, including the division of retirement benefits. For service members (not civilian contractors) the Soldiers and Sailors Relief Act provides protection by stating that a person's property or parental rights cannot be taken away if he or she is unable to appear in court due to military service.
Civilian Contractors
Civilian contractors have the especially complex issue of having the same problems as deployed service members but not being afforded the same protections under the Soldiers and Sailors Relief Act. While a civilian contractor is still serving his or her country, they are technically not considered a military member. Therefore, they cannot invoke the same rights under the Act as service members can. We can discuss your case if you are a civilian contractor and your best options.
