Seeking a Personal Protection Order

There are two types of protection orders in Colorado: civil and criminal. If police are called to your home during a domestic dispute and somebody is arrested, you will be dealing with the criminal justice system. Our lawyers can also help you obtain a protection order through the civil justice system prior to an arrest occurring.

If you are living with a person who is violent or abusive, we offer an initial consultation to discuss your case. If you present a fact pattern of domestic violence, we can immediately go to court and obtain a personal protection order (commonly known as a "restraining order"). If the order is granted, your spouse will have to vacate the marital residence. Approximately one week from the filing of the order, the court will hold a hearing to determine how long the order should stand.

An accusation of domestic violence can have a devastating effect on your life. As the alleged abuser, you will be removed from your home and could be prevented from having any contact with your children pending a full hearing. You will also be barred from possessing guns or other weapons for the duration of the order. If you violate the terms of the protection order, you can be jailed or face contempt of court charges.
