If you are a parent with primary residential custody, you can't move out of the state with your child without permission from the other parent or a court order. When Will Courts Approve Parental Relocation?

Colorado courts consider child removal cases based on the reasons for the move and how the relocation would affect the best interests of the child.

  • Is the move-away voluntary? If you have a good reason for the move such as a job transfer, the court is more likely to approve it.
  • How would the move affect other parent's visitation rights? If you are actively involved in your child's life, then courts are more likely to consider how the move would affect your child's relationship with you.

Colorado courts cannot prevent a parent from moving. However, they can prevent that parent from removing a child from the state.
